Advocate General agrees with concerns expressed by TAR (Regional Administrative Courts) of Sardinia and Lombardy about the automatic renewal of coastal and lakeside property concessions until 2020

The Advocate General Maciej Szpunar suggests that the Court of Justice should find the Italian law that extends automatically and generally the period of validity of coastal and lakeside concessions to 31 December 2020 to be in violation of Directive 2006/123/EC on services in the internal market.

The Advocate General shares the same perplexities as expressed by TAR Sardinia and TAR Lombardy, as well as by applicants in the main proceedings (who run business activities on the coast of Sardinia and on Lake Garda). Indeed, they consider the extension as excessively burdensome, disproportionate and unreasonable for competitors excluded from the market.
