The Court of Justice rules on the national legislation providing for the payment of a charge for the mandatory use of a vessel traffic services system depending on the length of the vessel concerned
Regulation (EEC) No 4055/86 precludes a national legislation providing that maritime traffic that is bound for designated ports of a Member State and that departs from ports situated in other Member States is subject to the payment, in respect of the mandatory use of the services of a vessel traffic services system, of a charge calculated solely on the basis of the length of the vessel, to the exclusion of any other factor, and from which maritime traffic between those designated ports is exempt, unless there is in fact a correlation between the cost of the services provided and the amount of that charge

The purpose of determining the amount of the reimbursement owed by the air carrier to a passenger in the event of cancellation of a flight includes the difference between the amount paid by that passenger and the one received by that air carrier, which corresponds to a commission collected by a company acting as an intermediary, without that air carrier being required to know its exact amount
