In determining or approving, on the basis of a proposal from the airport managing body, modifications of the system or the level of airport charges in the context of a mandatory procedure under national law, the independent supervisory authority is required to consult with the airport users with which that managing body did not duly consult when drafting such proposal

Directive 2009/12 prevents airport managing bodies from determining, together with an airport user, airport charges different from those set by that body and approved by the independent supervisory authority. Furthermore, it allows airport users to challenge directly the decision of the independent supervisory authority approving the charging system.
